These Terms and Conditions ("Terms") govern your access to and use of the Kalo AI calorie tracking mobile application ("App") and related services provided by Kalo Health Limited ("Company", "we", "us", or "our").

1. Acceptance of Terms

By downloading, accessing, or using the Kalo app, you ("User", "you", or "your") agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

2. Medical Disclaimer

IMPORTANT: Kalo does not provide medical advice, diagnosis, or treatment. The App is designed for informational and educational purposes only.

  • The information provided by the App, including calorie counts, nutritional data, health scores, and recommendations, is for general informational purposes only

  • You should always consult with a qualified healthcare professional, registered dietitian, or your doctor before making any changes to your diet, exercise routine, or health plan

  • The App's AI-powered features, including image recognition and personalized insights, provide estimates and suggestions that may not be medically accurate

  • Individual nutritional needs vary greatly based on personal health conditions, medications, allergies, and other factors

  • We strongly recommend seeking professional medical advice before beginning any weight loss, weight gain, or fitness program

  • If you have any medical conditions, food allergies, eating disorders, or are pregnant or nursing, consult your healthcare provider before using the App

You use the App at your own risk and discretion.

3. Subscription Services

3.1 Subscription Plans

  • Kalo Premium Monthly: £9.99 per month

  • Kalo Premium Annual: £29.99 per year (prices may vary by region)

3.2 App Store Purchases (In-App Purchases)

Important: App Store purchases are governed by Apple and Google's terms, not ours.

  • Subscriptions purchased through the Apple App Store or Google Play Store are subject to their respective terms and policies

  • Payment processing, billing, and refunds for App Store purchases are handled exclusively by Apple or Google

  • Subscription management: You must manage and cancel App Store subscriptions through your Apple or Google account settings, not through the Kalo App

  • Refund requests: Must be made directly to Apple or Google through their respective refund request processes

  • We have no control over App Store billing, refunds, or subscription management

  • App Store terms supersede: Apple/Google terms take precedence over any conflicting terms in this document regarding App Store purchases

  • Auto-renewal: Follows Apple/Google policies for automatic subscription renewal

3.3 Direct Website/Online Purchases (Order Form Purchases)

For subscriptions purchased directly through our website or order forms:

Refund Policy:

  • Annual Subscriptions: 30-day money-back guarantee from initial payment date and from each renewal date

  • Monthly Subscriptions: 14-day money-back guarantee from initial payment date and from each renewal date

  • Refund process: Contact support@thekalo.app with your order details to request a refund within the applicable period

  • Processing time: Refunds will be processed within 5-7 business days to your original payment method

Billing and Management:

  • Payment processing handled by our secure payment providers

  • You can manage website subscriptions through your Kalo account settings

  • Billing inquiries should be directed to support@thekalo.app

3.4 General Subscription Terms (All Purchase Methods)

  • Auto-renewal: All subscriptions automatically renew unless cancelled before the renewal date

  • Cancellation timing:

    • App Store subscriptions: Cancel at least 24 hours before renewal through your App Store account

    • Website subscriptions: Cancel anytime through your account settings or by contacting support

  • Pricing changes: We may change subscription prices with 30 days advance notice

  • Currency: Pricing displayed in your local currency where supported

  • Taxes: Applicable taxes will be added at checkout where required by law

3.5 Free Trial

  • If offered, free trials automatically convert to paid subscriptions unless cancelled before the trial period ends

  • You must cancel at least 24 hours before the trial ends to avoid charges

4. Age Restrictions and Eligibility

4.1 Age Requirement

You must be at least 18 years old to use the App. The App is not intended for use by individuals under 18 years of age.

4.2 Verification

By creating an account, you represent and warrant that:

  • You are at least 18 years of age

  • You have the legal capacity to enter into these Terms

  • All information you provide is accurate and complete

  • You will keep your account information updated

4.3 Geographic Restrictions

The App is primarily intended for users in the United Kingdom. We make no representation that the App is appropriate or available for use in other locations. If you access the App from outside the UK, you are responsible for compliance with local laws.

5. Acceptable Use

5.1 Permitted Use

You may use the App for personal, non-commercial purposes in accordance with these Terms.

5.2 Prohibited Activities

You agree not to:

  • Use the App for any unlawful purpose or in violation of applicable laws

  • Share your account credentials with others

  • Reverse engineer, decompile, or attempt to extract the source code

  • Use automated scripts, bots, or crawlers to access the App

  • Scrape, crawl, or harvest data from the App using automated tools

  • Create derivative works based on the App or its content

  • Use the App for any commercial purpose without our express written consent

  • Post or upload content that is harmful, offensive, illegal, or violates others' rights

  • Impersonate others or create false accounts

  • Engage in any activity that promotes eating disorders or dangerously low caloric intake

  • Use the App in any way that could harm, disable, or impair the service

6. Content and User-Generated Content

6.1 Our Content

All content provided through the App, including nutritional databases, algorithms, text, graphics, and software, is owned by us or our licensors and protected by intellectual property laws.

6.2 User-Generated Content

When you upload photos, create custom food entries, or submit other content:

  • You retain ownership of your original content

  • You grant us a worldwide, perpetual, royalty-free license to use, process, and analyze your content to provide App services

  • You represent that you have the right to share the content and that it doesn't violate any third-party rights

  • We may use aggregated, anonymized data from user content to improve our AI and services

6.3 Food Database

  • Our food database combines information from various sources, including user submissions

  • We do not guarantee the accuracy of all nutritional information

  • Users may contribute to and edit database entries

  • You use food database information at your own risk and should verify important nutritional details

7. Third-Party Services and App Stores

7.1 App Store Terms

  • If you downloaded the App from the Apple App Store or Google Play Store, you also agree to their respective terms

  • These Terms are between you and Kalo Health Limited, not the App Store providers

  • App Store providers have no obligation to provide support or warranties for the App

  • In case of conflicts between these Terms and App Store terms regarding purchases, the App Store terms prevail

7.2 Third-Party Integrations

The App may integrate with third-party services (health apps, payment processors, analytics providers). We are not responsible for third-party service availability, accuracy, or policies.

8. Intellectual Property

8.1 Our Rights

  • The App, including its AI technology, algorithms, design, and content, is owned by Kalo Health Limited

  • All trademarks, logos, and brand names are our property

  • We retain all rights not expressly granted to you

8.2 User Content

  • You retain ownership of content you upload (food photos, personal data)

  • You grant us a license to process, analyze, and use your content to provide App services

  • You represent that you have the right to upload any content you share

9. Data and Privacy

Your privacy is important to us. Please review our Privacy Policy, which governs how we collect, use, and protect your information. By using the App, you consent to our data practices as described in the Privacy Policy.

10. AI and Technology Limitations

10.1 AI Accuracy

  • Our AI-powered calorie recognition and nutritional analysis provide estimates

  • Results may not always be accurate and should not be relied upon as precise measurements

  • Food recognition accuracy depends on image quality and database availability

10.2 Database Limitations

  • Nutritional information is sourced from public databases and user submissions

  • We cannot guarantee the accuracy or completeness of all nutritional data

  • Values may vary from actual food products

10.3 BMR and Calorie Calculations

  • Our Basal Metabolic Rate (BMR) calculations are based on established formulas including the Mifflin-St Jeor equation, as referenced in medical literature

  • Calorie recommendations follow general guidelines from established health organizations

  • These calculations are estimates only and individual metabolic rates vary significantly

  • Factors such as genetics, medical conditions, medications, and other variables can affect your actual caloric needs

  • Our calculations should be used as a starting point only and may require adjustment based on your individual response

  • For personalized nutritional advice, consult with a registered dietitian or healthcare professional

10.4 Methodology References

Our calculations are based on methodologies referenced in established health sources, but we do not guarantee their accuracy for your individual circumstances. Always consult healthcare professionals for personalized advice.

11. Third-Party Services

The App may integrate with third-party services (payment processors, analytics providers). We are not responsible for third-party services' availability, accuracy, or policies.

12. Disclaimers and Warranties

12.1 No Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

12.2 Health and Safety Disclaimer

  • We do not provide medical advice, diagnosis, or treatment

  • All information is for general informational purposes only

  • Consult healthcare professionals before making health decisions

  • We disclaim all liability for health-related decisions based on App information

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE PROVIDE THE APP "AS IS" WITHOUT WARRANTIES OF ANY KIND

  • WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES

  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR SUBSCRIPTION SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM

  • WE ARE NOT LIABLE FOR ANY HEALTH-RELATED DECISIONS YOU MAKE BASED ON APP INFORMATION

14. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

15. Termination

15.1 Termination by You

You may delete your account and stop using the App at any time.

15.2 Termination by Us

We may suspend or terminate your access for violations of these Terms or for any other reason with reasonable notice.

15.3 Effect of Termination

Upon termination, your right to use the App ceases, but these Terms remain in effect regarding past use.

16. Geographic Restrictions

The App is primarily intended for users in the United Kingdom. We make no representation that the App is appropriate or available for use in other locations.

17. Changes to Terms

We may update these Terms periodically. We'll notify you of material changes through the App or email. Your continued use constitutes acceptance of updated Terms.

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force and effect.
